GROUNDS MAINTENANCE SPECIFICATIONS AND AGREEMENT FOR <br />SILVER VIEW PARK <br />THIS GROUNDS MAINTENANCE AGREEMENT, is made and entered into as of the <br />day of by and between , a <br />Minnesota corporation (Contractor), and the City of Mounds View, located at <br />2401 Highway 10, Mounds View, Minnesota (Contractee): <br />ARTICLE 1 <br />DEFINITIONS <br />1.1 Grounds - The term "Grounds" means all park facilities located within <br />the 51.9 acre park complex located at Silver View Park, located in Mounds View, <br />Minnesota, shown to contractor by Contractee's representative, and mutually under- <br />stood to be the area for which services pursuant to this Agreement are to be <br />rendered as per Addendum A. <br />1.2 Month - A month for the purpose of this AgreemenL shall be a calendar <br />month. <br />1.3 Representative - The term "Representative" shall mean the individual <br />(Director- Parks, Recreation and Forestry ) appointed by Contractee to communicate <br />with Contractor for the coordination of the maintenance of the Grounds, and shall <br />be authorized to act on behalf of Contractee. <br />ARTICLE 2 <br />COMPENSATION AND TERMS <br />2.1 Compensation - As consideration for Contractor providing the services <br />described hereinatter, Contractee shall pay to Contractor <br />per month for maintenance of the Grounds. All invoices for <br />services rendered shall be due and payable within thirty (30) days of receipt. <br />2.2 Construction - Nothing herein contained shall be construed as an <br />obligation on the part of Contractor to extend credit to Contractee, nor as an <br />obligation to continue to provide services to Contractee in the event timely pay- <br />ments are not received. In such event, Contractor may terminate this contract as <br />provided in Article 5.1 herein. <br />ARTICLE 3 <br />MAINTENANCE SERVICE <br />3.1 S_Rr_in9 Cl—e_a�n-u - Spring clean-up is to be completed as soon as weather <br />and ground con itiodT' ns permit and no later than May 15th. <br />Spring clean-up to include the following activities: <br />a. Power sweep or hand rake, as required, the entire turf (sodded and <br />seeded ) area of development. <br />b. Hand rake around buildings and obstacles, as required. <br />
