42.05 <br />above shall have 15 days in which to submit their comments <br />regarding the proposed subdivision to the Municipality. <br />P The Clark -Administrator, Planning Commission, or Council <br />may request the above authorities to similarly review and <br />conuncnt on the preliminary subdivision plan of any minor <br />subdivision request whenever such review is deemed neces- <br />sary to properly evaluate the request. <br />4 4 (P) Preliminary plats of major subdivisions, which conform <br />to the Municipal Storm Water Drainage Plan, shall be sub- <br />mitted to the Rice Creek Watershed District for their <br />review and comment. Preliminary plats, which do not so <br />conform, shall be revised by the subdivider according to the <br />stipulations of the Planning Commission and City Engineer <br />prior to submission to the Rice Creek Watershed District. <br />{9} (C) After comments have been received from the authorities <br />indicated in paragraph (5) above, a report shall be prepared <br />by the Clerk -Administrator and submitted to the Planning <br />Commission with copies of the preliminary plat or surveyor's <br />certificate within thirty (30) days following acceptance for <br />filing. The report will address how the proposed subdivi- <br />sion will affect traffic, utilities, drainage, community <br />facilities, public safety, neighboring land uses, natural <br />features, open spaces, the Comprehensive Plan, and any other <br />matters concering public health, safety and welfare. <br />{8} (H) The Planning Commission shall have the subdivision <br />request on its agenda at its next regular meeting following <br />receipt of the Clerk -Administrator's report. The subdivider <br />or his representative shall be present at this meeting. <br />49} (I) Within sixty (60) days of receipt of the subdivision <br />request and the Clerk -Administrator's report, the Planning <br />Commission shall recommend to the Council approval or dis- <br />approval of the subdivision. The Planning Commission may <br />withhold action to so recommend until the comments of the <br />Rice Creek Watershed District and other agencies have been <br />received. <br />410} (J) Preliminary plats of major subdivisions shall require <br />a public hearing. The Council shall conduct such hearing <br />within at least thirty (30) days of receipt of the Planning <br />Commission recommendation. The Clerk -Administrator shall <br />cause notice of said hearing to be published in the official <br />newspaper at least ten (10) days prior to the hearing, and <br />shall also cause a notice to be mailed to each of the owners <br />of property within 350 feet of the property being platted, <br />such notices to be mailed to the last known address of such <br />owners at least ten (10) days before the hearing. <br />
