CMEMO TO: Clerk -Administrator and City Council <br />FROM: Engineering/Planning Technician��i <br />DATE: November 4, 1982 <br />SUBJECT: VEHICLE SALES AT NORTHEAST MARINE <br />The Planning Commission at their November 3rd Regular Meeting <br />directed staff to forward to the City Council their concerns regard- <br />ing the selling of vehicles by a used car dealer at Northeast Marine <br />located at Silver Lake Road and Highway 10. The Planning Commission <br />had noticed two pickup trucks with "for sale" signs in their windows <br />parked on the Northeast Marine property. Staff was directed by the <br />Planning Commission to determine ownership of the vehicles. A check <br />on these vehicles revealed that they are the possession of a used <br />car dealer. Staff was informed by the Police Department that the <br />owner of Northeast Marine is a licensed car dealer, and the two <br />vehicles in questions are being sold by a dealer whose business name <br />is Northeast Marine. <br />The Planning Commission is concerned about possible zoning violations <br />involving the selling of used vehicles in areas where businesses other <br />than auto sales exist or in residential areas. It is the opinion of <br />Attorney Meyers that in order for a particular location to sell used <br />cars, it must first be properly zoned and secondly, the dealer must be <br />licensed in the City. In the case of Northeast Marine, the property <br />is properly zoned for motor vehicle sales although an existing business <br />presently occupies the property, and the dealer is not licensed in <br />the City to conduct used car sales. <br />The Planning Commission does not <br />become a used car lot and would <br />direct staff should you need any <br />FJR/bc <br />i <br />want this property, over time, to <br />recommend Council review.
