MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 56-112 <br />CITYOF MOUNDS VIEW <br />COUNTY UP RAMI;EYI,Y <br />STATP OF MTNNESOTA <br />RESOLUTION APPROVING THE COND11-10NAL USE <br />PERMIT REQUEST AND DEVELOPMENT PROPOSAL OF <br />WAYNE HERR CON';TRUCTION COMPANY <br />WHEREAS, the applicanL, Wayue 11orr, has requested to construct <br />4-II ,nit condominitun building) aL a :;iLv lortited at 2900 Highway 10; <br />and <br />WHEREAS, the applicant is requesting Development Stage approval <br />for this project under the Planning Unit Development Chapter of the <br />Zoning Code; and <br />WHEREAS, per existing Zoning Code, a conditional use permit is <br />required for residential P.U.D. projects; and <br />WHEREAS, the Planned Unit Development is intended to introduce <br />flexibility of site design and architecture for the conservation of <br />land and open space through clustering of building and activities <br />Lhrough conditional use provisions; and <br />WHEREAS, the site plan submitted meets minimum zoning and planned <br />un.i(. development zon.inq requirement:;; And <br />WHEREAS, the development is cuusisLanL with the existing zonigg <br />for the property, R-4, High Density Residential; and <br />WHEREAS, condominium developments arc allowed in an R-4, High <br />Density Residential District; <br />NOW, THEREFORE, DE IT RESOLVED that the Mounds View Planning <br />Commission recommends approval of the conditional use permit request <br />under the Residential P.U.D. Chapter of the Zoning Code provided that: <br />1) An open space buffer be maintained between the southernmost <br />condominium unit and the R-1, Single Family Residential Area. <br />Such open space shall be no less thatn 156 feet from north to <br />south. <br />2) The full 25 foot roadway width be maintained during all seasons <br />for emergency vehicle access on all streets within this develop- <br />ment including the 25 foot road easement to the south of this <br />property. <br />3) The design of the knock down barrier be submitted and approved <br />by the Fire Chief prior to conditional use permit final approval. <br />4) A landscape plan shall be submitted to conform with Chapter 40.22, <br />Subdivision D(10). <br />
