M c ' <br />MEMO TO: Mayor and City Counci <br />PROM: Clerk-Administrator,i <br />DATEc December 30, 1982 <br />SUBJECT: GAMBLING DEVICES ON THE PREMISES OF INTOXICATING <br />AND NON -INTOXICATING LIQUOR LICENSEES <br />Pursuant to Council direction at the December 27, 1982 meeting, <br />staff has discussed the referenced matter with City Attorney <br />Meyers. Chapter 100.08(7) and 101.08(6) of the Municipal Code <br />prohibit gambling devices on the premises of intoxicating and <br />non -intoxicating liquor licensees, respectively. \\ <br />Attorney Meyers has advised that this is a local law and not <br />part of any State law incorporated into our Code. He has indicated <br />that there are two basic options available to the Council, they are: <br />1) Prohibit completely gambling and gambling devices on <br />the premises of an intoxicating liquor and/or a non - <br />intoxicating liquor licensee. <br />"1 2) Allow gambling devices on the premises when sales of <br />intoxicating liquor, set-ups, and non -intoxicating <br />liquor and the possession of intoxicating and non -intox- <br />icating liquor by patrons is prohibited. <br />Mr. Jambor related in a telephone conversation on December 29, 1982 <br />that he would abide by the decision of the City Council in this <br />matter. <br />Staff would request Council direction in this matter as it relates <br />to the applications for gambling device permits from Golden Gloves, <br />Inc. and the Spring Lake Park Lions. Also, staff would request <br />Council direction an any limitations you might wish to place on the <br />already approved gambling device permit for the Casino Night to be <br />held by the Mounds View -Shoreview Lions Club on Wednesday, January <br />5, 1983. <br />DFP/bc <br />
