Flood Plain Zoning Ordinance Review (Chapter 49) <br />4 9. 02 Subdivision 9(e). Sets minimum floor elevation <br />at 905. Applicant proposes building at 905 contour, <br />meeting Code requirements. <br />49.04 Subdivision 1(d). Portions of the dwelling <br />building, parking area and lawn area are proposed within <br />the flood plain areas provided no additional fill is <br />required. Additional fill is required within the flood <br />plain area to accommodate the building and parking area. <br />Subdivision 2. The placement of fill within a flood at: <br />.i,� <br />zoning districc requires a conditional use permit. ;,' <br />Subdivision l(a). This section prohibits the granting of <br />a conditional use permit when the proposal/fill will <br />increase the flood height. The applicant's proposal <br />anticipates the filling of less than 17 cubic yards of <br />flood plain (which is approximately .0104 AC/FT), under i <br />the building itself. An additional 1.5 cubic yards• of <br />fill is needed to accommodate the the north parking area. <br />This combined amount of fill will not significantly <br />increase the flood height and any increase in flood height, <br />will be undetectable. <br />Subdivision 7(b). question to be answered is whether the <br />proposed fill is the minimum necessary to accommodate the - <br />buildings. <br />49.05 Subdivisions. Since the property needs to be <br />combined because of the buildings$ this section would <br />apply. <br />
