63.05 <br />"Opening Burning" - burning any matter whereby the <br />resultant combustion products arc omitted directly to the <br />open atmosphere without passing through an adequate stack, <br />duct, or chimney, <br />"Refuse" - any combustible waste material, trade waste or <br />garbage containing carbon in a free or combined state. <br />"salvage Operation" - any business, trade, industry or <br />other activity conducted in whole or in part for the <br />purposes of salvaging or reclaiming metals or chemicals or <br />other products or materials, <br />"Authorized" - approval of the Director and Fire Depart- <br />ment as evidenced by a permit from both agencies. <br />(b) Exception. Recreational fires are permitted. These <br />regulations shall not apply to wood burning fireplaces nor <br />to fires used solely for the preparation of food by barbe- <br />cuing, <br />(c) Permit Required. Not withstanding a permit from the <br />Director to conduct open burning, a permit must be <br />obtained from the Fire Department prior to any burning. <br />(d) special Requirements. All authorized open burning <br />must comply with the fo owing: <br />(1) The location is not less than 50 feet from any <br />structure on the property on which the burning is <br />conducted and adequate provisions are made to prevent <br />fire from spreading to within 50 feet of any <br />structure. <br />(2) A competent person must be in constant attendance <br />until the open burning is extinguished. This person <br />shall have a garden hose connected to the water supply <br />or other fire extinguishing equipment readily avail- <br />able for use. <br />(3) Burning is only permitted from 6:00 p.m. to 6:00 <br />a.m. on any day. <br />(4) Minnesota Air Pollution Control Agency Rule No. 8 <br />is hereby adopted in full and by reference and shall <br />be in full force and effect in this City. <br />(e) Chief May Prohibit. The Chief of the Fire Department <br />may proh bit any or all authorized open burning when <br />atmospheric conditions or local circumstances make such <br />fires hazardous. (219) 1 <br />
