Anderson, Dir tr <br />parks, Recreation and tstry <br />DATE: October 1.3, 1983 <br />RE: ordinance #349 <br />As you are aware, the second reading of ordinance 4349 modifying <br />Chapter 35 is scheduled for Monday, October 24, 1983. City <br />Attorney Richard Meyers contacted staff on Thursday morning <br />regarding some minor changes that he feels should be made to the <br />ordinance as initially submitted. The two changes are as <br />follows: <br />1. Under 35.03 Organization; item #1, we have rewritten it to <br />read that the Commission will meet the first Tuesday of each <br />month or as deemed necessary by the chairperson. <br />2. Under 35.06 Removal from Office; it has been reworded to read <br />as follows: "Any member of the Commission may be removed if <br />said member misses two consecutive meetings without a valid <br />reason, and for cause duly found by a two-thirds vote of the <br />commission members and consent of the City Council." Under <br />this change, we have added the phrase, "said member misses" <br />and deleted the phrase "if the Commission duties are not <br />faithfully carried out" as Attorney Meyers feels this is too <br />ambiguous. <br />A copy of the revised ordinance is attached for your review.
