,/& );1 7 <br />MEMO TO: Mayor and City Council <br />FROM: Director oC Public Works/Community Development <br />DATV: NOVClllber 3, 1983 <br />SUBJECT: STATUS REPOR'1' ON LONG LAKE ROAD DITCH IMPROVEMENT <br />PROJECT 1982-2 <br />AtLached .is a copy of a letter daLed November. 2, 1983 from <br />Ms. Sharon Rushton, an associate of Attorney Meyers. The letter <br />recommends that certain actions be taken to exercise the City's <br />rights under the contract and bond posted on the Long Lake Road <br />Ditch Project by the contractor. <br />As some of you may be aware, this project has been left <br />uncompleted since June of 1982. All attempts to get the <br />contractor and/or bond company to complete the project have <br />failed. Staff previously requested Council to authorize to <br />proceed to complete the project. <br />RECOMMENDATION: Staff recommends to the Council that authoriza- <br />P'\ tion be given to do the following items: <br />I. Proceed per the guidance outlined in the letter dated <br />November 2nd from Sharon Rushton. <br />2. Authorize staff to direct Short -Elliott -Hendrickson to <br />prepare necessary bid documents and assist in project <br />administration as necessary to see through the completion. <br />3. Authorize staff to direct Short -Elliott -Hendrickson to <br />perform necessary field surveys of the project area to <br />determine the exact amount of work necessary to complete <br />the project. <br />9. Authorize staff, to notify and, if necessary, initiate law <br />suits against either the bond company or the contractor <br />to cover the City's costs. <br />5. Authorize staff to use S.N.M. funds to complete the work <br />and cover the expenses of completing the work.
