MEMO TO: Mayor and City Council <br />rants; Clerk-T.dminis <br />DATE: June 2, 1982 <br />SUBJECT: PETITION FOR STREET VACATION <br />Attached please find a petition received by this office on June 2, <br />1982 for the vacation of the Fairchild Avenue right-of-way from <br />Laport Drive to Ardan Avenue. The petition is signed by three of <br />the five property owners that would be affected by the vacation of <br />this easement. <br />As you may recall, approximately one year ago at your May 11, 1981 <br />Council meeting, City Attorney Meyers reported on a potential <br />vacation of this section of street due to a telephone request <br />received by this office at that time. Mr. Meyers referred to the <br />provisions of the Charter, specifically, Chapter 12.06, which <br />states that the Council may, by ordinance, vacate any street or <br />alley within the City after notice has been published in the City's <br />official newspaper and opportunity has been given to affected property <br />owners and the public to be heard on the vacation. <br />In order for staff to respond to this petition, it would be appreciated <br />if Council would give direction in this matter regarding your desire <br />to consider the vacation of this easement. Should you desire to du <br />so, it would appear appropriate for a public hearing to be scheduled <br />for consideration of the petition of vacation and allowing for public <br />input. This hearing could be scheduled under your June 19th Consent <br />Agenda for June 28th. Your direction in this matter will be greatly <br />appreciated. <br />DFP/pf <br />LW- <br />
