MEMO TO: Mayor and City Council <br />Planning Coumiissiun <br />FROM: Clerk-Administratuio(C <br />DATE: June 10, 1982 <br />SUBJECT: FAIRCHILD AVENUE RIGHT OP -WAY VACATION <br />On June 2, 1982 the City received a petition, copy attached, from <br />three of tile five abutting property owners to the portion of <br />Fairchild Avenue right-of-way between Ardan Avenue and LaPort Drive <br />requesting the City vacate this right-of-way. <br />Section 12.06 of the Mounds View Home Rule Charter provides for the <br />vacation of streets by the City after public notice is published, <br />copy of notice published in New Brighton Bulletin on June 17, 1982 <br />attached, and opportunity is given to interested citizens and <br />affected property owners to be heard on the matter. Should a <br />vacation be approved by resolution of the City Council the vacated <br />right-of-way would revert back to the abutting property owners <br />with ownership being established from the mid -point of the <br />right-of-way. <br />In the case in question, each abutting property owner would receive <br />15 feet of the 30 foot wide right-of-way for the length of their <br />frontage. <br />As shown on the attached map, the petitioning property owners own <br />land which has been subdivided and developed in such a way that <br />frontage on this portion of Fairchild Avenue is not of benefit <br />to them. Staff is unaware of any plans by the other two abutting <br />property owners to subdivide their lots. These owners have been <br />mailed notice of the hearing on June 28, 1982 for the vacation <br />request. <br />It should be further pointed out that the development of this <br />portion of Fairchild Avenue would be difficult, if not impossible, <br />due to the fact that the existing right-of-way is 30 feet wide <br />which is insufficient for the development of a street, thus, <br />requiring additional right-of-way acquisition if a street would <br />be developed. Any acquisition that might occur for the full <br />length would be inhibited by the development that has and is <br />occurring in the area along Ardan Avenue adjacent to this portion <br />of Fairchild Avenue. <br />Upon direction of the Council, staff will prepare the appropriate <br />resolution approving or rejecting the requested vacation. <br />I <br />DFP/pf <br />�i <br />
