MLMO TO: Mayor and City Council <br />n <br />FROM: Clerk -Administrator. <br />DATE: August 1, 1983 <br />SUBJECT: FAIRCHILD AVENUE RIGHT -OP -WAY <br />Attached please find a copy of Resolution No. 1469 adopted by the <br />Mounds View City Council on August• 9, 1982, regarding the vacation <br />of a portion of the Fairchild Avenue right-of-way between Laport <br />Drive and Ardan Avenue. You will note under Provision 2 that the <br />resolution provided that• within one year following the date of <br />the adoption of the resolution the Council would consider the <br />paving, curb and gutter, storm drainage, watermain, and sanitary <br />sewer systems for the portion of Fairchild Avenue cul-de-sac lying <br />north of Laport Drive. <br />Pursuant to the provisions of this resolution, I am placing this <br />item before you for your consideration and direction to staff as <br />to your desires with respect to this matter. <br />During the past year no action has been taken by any of the involved <br />parties who objected to the initial vacation as it was their desire <br />to subdivide their large lots and any vacation would prohibit such <br />action on their part. Also, as you will recall., we have received <br />several objections from residents in the area with respect to the <br />maintenance of that area by the property owner and the use of <br />the remaining portion of right-of-way by children as a BMX track. <br />Staff would request Council direction in this matter should you <br />desire to pursue this issue at this time. <br />DFP/pf <br />Attachment <br />
