-2- <br />on the other hand, this would prohibit the operation <br />of a "bar area" in the sense that people could not <br />be seated at the bar. <br />b. The use of the St. Louis Park provisions would <br />guarantee that "entrees" would be served and <br />adequate staff would be on duty. <br />c. In both of these options there is not a guarantee <br />that food will be purchased by the customer ordering <br />liquor. It would only guarantee that the patron <br />would be seated at tables and/or that adequate <br />staff is on duty and food is available for consumption <br />by the patrons. <br />2. Limit the issuance of on -sale licenses to restaurants, <br />hotels, and clubs as defined by state law. <br />Considerations: a. This would prohibit the sale <br />and service of liquor by "bar" operations. In the case <br />of Mounds View, Loose -Ends and Povlitzki's would be re- <br />quired to start functioning as restaurants and,pending <br />a legal interpretation,prohibit the service and sale <br />of liquor in the bowling alley and recreational areas <br />of the Mermaid. I <br />b. Allowing for on -sale licenses for commercial/recrea- <br />tional clubs,as is the case of Bloomington,could <br />ease the problems with the Mermaid, however, the <br />definition would need to be properly structured so as <br />to avoid any misuse of such a provision. <br />3. Include the definition of restaurant in the City's <br />liquor code and require seating in excess of <br />current statutory provisions. <br />Considerations: This provision would in no way address <br />the issues currently of concern to the City Council <br />but would simply guarantee that any on -sale operation <br />wishing to obtain a liquor license under the restaurant <br />definition would be of sufficiently large enough size <br />to allow us to avoid the possibility of issuing on -sale <br />liquor licenses to "hole in the wall" operations. <br />4. Require public hearings be held prior to the issuance <br />of new and renewal of existing on -sale liquor licenses. <br />Considerations: By having public hearings held prior to the <br />issuance and renewal of on -sale liquor licenses, the opportunity <br />would be afforded to members of the public to comment on the J <br />proposed or current operation. <br />
