-3- <br />5. As is the case in Brooklyn Park, include a provision in <br />the Code that would allow the City Council to restrict <br />the sale and consumption of liquor to tables where <br />food is served to patrons purchasing and consuming the <br />liquor and prohibit or limit the sale and consumption of <br />liquor at a bar. <br />Considerations: This would address the issue of Sunday <br />liquor sales and the service of food in its entirety <br />by requiring that liquor sales occur only when the <br />persons consuming the liquor also purchase food. The <br />only possible loop hole in the Brooklyn Park provisions <br />are that food is not defined and as has been discussed <br />on previous occassions provides for a wide margin of <br />interpretation. <br />As was the case with several other options <br />previously mentioned, such a requiremont would more than <br />likely prohibit the service and sale of liquor in the <br />bowling alley and recreational areas of the Mermaid and <br />would require that the Mermaid, Loose -Ends, and Povlitzki's <br />operate on a restaurant basis only if they wish to remain <br />open on Sundays. <br />6: The final option identified by staff would be to <br />require that liquor sales on Sunday and, if desired <br />during the remaining part of the week,represent <br />only a certain portion of the operationb revenues <br />with the remaining portion being derived from the <br />sales of food. If it is the desire of the Council <br />to make this provision applicable on all days of <br />the week, it would be recommended that liquor licenses <br />be limited to hotels, restaurants, and clubs only <br />as there is no way possible that a "bar" operation <br />could meet such requirements. The three options <br />available using the percentage of gross revenues <br />derived from food method would be to require that <br />food sales represent a minimum percentage of total <br />sales for all operations, require food sales represent <br />a certain percentage of gross sales based on the <br />amount of seating the operation has available, or <br />issue classes of licenses where different classes <br />are determined based upon the percentage of revenues <br />being derived from food sales. <br />Considerations: a. This would prohibit the sale and <br />service of liquor by "bar" operations. In the case of <br />Mounds View, Loose -Ends and Povlitzki's would be required <br />to start functioning as restaurants and probably prohibit <br />the sale and service of liquor in the bowling alley and <br />recreational areas of the Mermaid. <br />
