A\
Mr. Donald F, Pauley
Clerk -Administrator
City of Mounds View
Mounds View, Minnesota 55112
Ref Licensing
Dear Mr. Pauley:
The City has a general power to require licenses for the protection
of the public health, safety and welfare under its general police
A regulatory license fee can be levied if the amount of the fee is
reasonably related to the probable costs of inspection and admin-
istration, otherwise any excess would be improper taxation. Generally,
the city councilts determination of the license fee will not be
disturbed by the courts since great weight will be given to a
legislative declaration. Lyons -v- Minneapolis, 241 Minn 439. 63 NW2d
585 (1954).
The District Court decision in the West St. Paul case, as presented
in summary form by National Amusement Company restates the basic law.
Since this case was not heard by the Minnesota Supreme Court it
actually has little legal impact, except against West St. Paul and
in the jurisdiction where the case was heard. It of course would be
cited by a litigant if said litigant thought it would influence
another judge in another court.
Yours
RM/amm
