Generally, <br />the city councilts determination of the license fee will not be <br />disturbed by the courts since great weight will be given to a <br />legislative declaration. Lyons -v- Minneapolis, 241 Minn 439. 63 NW2d <br />585 (1954). <br />The District Court decision in the West St. Paul case, as presented <br />in summary form by National Amusement Company restates the basic law. <br />Since this case was not heard by the Minnesota Supreme Court it <br />actually has little legal impact, except against West St. Paul and <br />in the jurisdiction where the case was heard.
