,.-, MEMO TO: Mayor and City Council <br />FROM: Clerk-Administrato <br />DATE: April 11, 1984 <br />SUBJECT: MUNICIPAL CODE CHAPTER 100, INTOXICATING LIQUORS, <br />MODIFICATIONS <br />Pursuant to your direction at the Agenda Session on April 2, 1984 <br />staff would suggest the following modifications to Municipal Code <br />Chapter 100 regulating intoxicating liquors: <br />1. Amend 100.01 by adding Subdivision 7 which would read as <br />follows: <br />Subdivision 7. Food. Food, as the term is used herein, <br />shall mean a menu consist ng of not less than three separate <br />and distinct entrees, complete with vegetable, salad, rolls or <br />bread, and a selection of beverages. <br />2. Amend 100.02, Subdivision 4, to read as follows: <br />Subdivision 4. Sunday Sales. S ecial on -sale licenses <br />for the sale of intoxicating liquor on Sunday separate from a <br />regular "on -sale" license issued pursuant to Section 100 02 subdivision 2, of this Cha ter shall be issued to hotels, <br />restaurants or clubs as defined in Section 100.01, Subdivision 1, <br />and which have facilities for serving not less than 30 guests <br />at one time. <br />3. Amend 100.05 by renumbering the current Subdivision 3 to <br />Subdivision 4 and adding the following as the new Subdivision 3: <br />Subdivision 3. Hearing. No issuance of a new license <br />or transfer or renewal of an existing license for the sale of <br />intoxicating liquor "on -sale", "off -sale", Sunday sale or <br />"on -sale wine" shall be hereafter granted by the Council until <br />a public hearing has been conducted by the Council after <br />published notice in the official newspaper at least 10 days in <br />advance of the hearing. <br />The above three items should fulfill all of the requirements you <br />stated you desired to see at the April 2nd Agenda Session, however, <br />these proposed revisions have not been reviewed by the City Attorney <br />and,should you find them acceptable, will need to be submitted to him <br />for his review and comment prior to their formal adoption. <br />If you find these revisions acceptable, please advise and I will <br />forward them to City Attorney Meyers for his review. <br />DFP/pf <br />
