MEMO TO: Director of Public Works/Community Development <br />Clerk -Administrator <br />City Council <br />FROM: Building Inspector <br />DATE: May 17, 1984 <br />SUBJECT: MERMAID SUPPER CLUB CURBING REQUIREMENT <br />History <br />Attached is a letter from Daniel Hall of the Mermaid Supper Club <br />requesting release of the security required by Development Agreement <br />No. 78-13. <br />The Mounds View City Council in 1978, as part of Development Agreement <br />No. 78-13 with the Mermaid Supper Club, required that the concrete <br />curbing (B-6-18) be installed no later than May 3, 1983. The Mermaid <br />has posted a $15,000.00 bond during this interim as security to be <br />sure the curbing committment is completed. Obviously, May 3, 1983 has <br />come and gone and the surface curbing used is still there. The <br />purpose at the time for the requirement was due to the fact the City <br />was just establishing the requirements for curbing, but we had not yet <br />put it into ordinance foiai. The USA of the curb and gutter section at <br />that time wa sensible due to the large lot involved anu' to control the <br />drainage on the property. <br />Today <br />The surface curbing installed is in reasonable condition. Although <br />sections have been dislocated due to snow removal and auto contact, <br />the Mermaid has most a]iays made repairs immediately. DuP to the <br />sloping of the property site, drainage has not appeared to be a <br />problem. Curbing is an ordinance requirement which can be enforced at <br />the time of new development or remodeling/additions, Please note we <br />require concrete curbing of other projects. <br />Action Necessary <br />Please direct staff as to your consideration in this matter. Staff <br />would recommend allowing release of the security by putting the <br />Mermaid owner on notice that permanent curbing (B-6-18) will be <br />required with any further additions or if drainage problems occur. <br />SAR/bc <br />�' Attachments <br />
