i <br />MEMO TO: Clerk -Administrator & City Council <br />FROM: Director of Public Works/Community Development <br />DATE: May 23, 1984 <br />SUBJECT: Pine Crest Park Development Proposal <br />Attached please find a copy of the Minnesota Department of Trans - <br />portion's May 8, 1984 letter on the subject project approving a <br />full median cross over under certain conditions. I wish to <br />clarify staff's position on who should be responsible for <br />complying with these conditions. <br />Condition 1. All road work cost should be paid for by the <br />developer. <br />Condition 2. All of the cost should be paid by the <br />developer. <br />Condition 3. The City should commit itself to completing a <br />system of local streets which can provide all access aided by <br />the parcel being developed. Also, the City should agree to <br />not permit any additional access to Trunk Highway 10 between <br />County Road H and County Road H2. <br />Condition 4. The developer should be reponsible for placing <br />' the Wooddale int rsection halfway between County Road H and <br />County Road H2 intersections to provide for better traffic <br />flow should a signal be needed. <br />If you agree with the staff position on this matter, we would ask <br />your authorization to advise Mr. Buyum, Mr. Waste & N . "rLst of <br />the requirements, which would become part of any development <br />agreements, and indicate to Mr. Buyum that unless Mr. Waste & <br />Herbst begin the development process within the period of time <br />needed to finalize Mr. Buyum's D.A. that all developer costs will <br />be paid by Mr. Buyum. <br />One question you might have is who will pay the annual operation <br />and maintenance cost? In a conversation with Mr. Kermit K. McRae <br />of the Minnesota Department of Transportation, he indicated that <br />the City pays power and routine maintenance costs. Routine <br />maintenance basically means that we paint the signal poles in 5 <br />to 7 years. As with other signal systems, the state will have an <br />agreement with the City stating that the state will keep the <br />signals in operating condition. <br />SWT/mb <br />
