i MEMO TO: Clerk -Administrator & City Council FROM: Director of Public Works/Community Development DATE: May 23, 1984 SUBJECT: Pine Crest Park Development Proposal Attached please find a copy of the Minnesota Department of Trans - portion's May 8, 1984 letter on the subject project approving a full median cross over under certain conditions. I wish to clarify staff's position on who should be responsible for complying with these conditions. Condition 1. All road work cost should be paid for by the developer. Condition 2. All of the cost should be paid by the developer. Condition 3. The City should commit itself to completing a system of local streets which can provide all access aided by the parcel being developed. Also, the City should agree to not permit any additional access to Trunk Highway 10 between County Road H and County Road H2. Condition 4. The developer should be reponsible for placing ' the Wooddale int rsection halfway between County Road H and County Road H2 intersections to provide for better traffic flow should a signal be needed. If you agree with the staff position on this matter, we would ask your authorization to advise Mr. Buyum, Mr. Waste & N . "rLst of the requirements, which would become part of any development agreements, and indicate to Mr. Buyum that unless Mr. Waste & Herbst begin the development process within the period of time needed to finalize Mr. Buyum's D.A. that all developer costs will be paid by Mr. Buyum. One question you might have is who will pay the annual operation and maintenance cost? In a conversation with Mr. Kermit K. McRae of the Minnesota Department of Transportation, he indicated that the City pays power and routine maintenance costs. Routine maintenance basically means that we paint the signal poles in 5 to 7 years. As with other signal systems, the state will have an agreement with the City stating that the state will keep the signals in operating condition. SWT/mb
