MEMO TO: MAYOR AND CITY COUNCIL <br />FROMt CLERK -ADMINISTRATOR <br />DATE: FEBRUARY 8, 1985 <br />SUBJECT: MUNICIPAL CODE CHAPTER 6 REVIEW <br />As a result of comments made during the February 4th Agenda <br />Session, Staff has reviewed the recomendations with respect <br />to Section 6.12, Layoffs, and 6.13, Suspension, of the <br />Personnel Code of the City. <br />The concern that an employee recently transferred to a <br />higher grade within the City might be layed off as a result <br />of the provision that• layoffs are made on the basis of <br />seniority when all other job relevant qualifications are <br />equal is a valid concern, particularly when the employee <br />might be a senior employee within the organization and more <br />senior than other individuals in the grade the employee <br />recently transferred out of. Staff would suggest the <br />inclusion of additional language in this section of the code <br />that would allow a senior employee to "bump" a less senior <br />employee from other positions within the City for which they <br />are qualified. I am aware that this is the policy of many <br />private industries in the Metropolitan Area such as <br />Medtronic, Inc. with which I am familiar due to my wife's <br />employment there. If it is the desire of the Council to <br />include such language I will undertake whatever efforts <br />nece sary to obtain the appropriate language for this <br />section per your direction. <br />Wtih respect to Section 6.13 regarding layoffs I would like <br />to suggest that the following language be used to replace <br />that currently within the code and to clarify that which I <br />originally recommended. The new language would be, <br />After consultation with the Mayor, the Clerk - <br />Administrator may suspend any employee without pay <br />for disciplinary reasons for a period not to <br />exceed five working days. Said suspension must <br />be affirmed by resolution of the City Council <br />no later than seven calendar days after the suspen- <br />sion is ordered. <br />The cumulative total of all suspensions for any one <br />employee shall not exceed thirty working days during <br />any one calendar year. <br />Your direction would be appreciated in this matter. <br />DFP/mjs <br />
