The rezoning would inhibit the commercial use of the site and <br />promote residential redevelopment. <br />The procedure used to implement the reroning would be: <br />Place a development moritorimm on the area being considered for <br />rezoning. <br />2. Conduct a rezoning study to detvrmiue the appruprlaty zoning district <br />for the area. <br />3. Process the rezoning in accurdauce with the City's zuniug procedures. <br />If upon review of the applicant's rcyursl., the City rinds the proposed use to <br />be acceptable and chooses to approve the conditional use permit, the following <br />items should be addressed: <br />Planning District 6 of the Comprehensive Plan should be. amended to reflect <br />a change in proposed land use. <br />2. The applicant's site conforms to the B-3 lot area and lot width requirements. <br />i 3. Site drainage plans must be submitted for review and approval of the <br />City Engineer. <br />4. The six foot high fence at the perimeter of the property is acceptable, <br />however, the fence cannot extend beyond the front building line. The <br />site plan shows that the fence goes beyond the building on both sides of <br />the lot. The fence should be setback in conformance with the zoning <br />requirements. Landscaping should replace the fence in these areas to <br />screen adjacent residential properties. <br />5. Building setback. The building complies with the 0-3 setback standards. <br />The canopy proposed over the gas pumps encroaches into the fronc yard <br />setback within 18 feet of the property line. The Mounds View Zoning <br />Ordinance makes no setback exception for these canopies. As such, the <br />structure is in violation, of Lhe raquirad setback, Three options are <br />available to correct this violation: <br />a. Revise the site design to comp;y with the established setback <br />standard. <br />b. Consider a variance from the established setback. <br />c. Consider a Zoning Ordinance amendment to specifically address <br />gas station canopies. <br />
