tiYw rvv � <br />MEMO TO: MAYOR AND CITY CUU L <br />FROM: CLERK -ADMINISTRATOR <br />DATE: MAY 2, 1985 <br />SUBJECT: MOUNDS VIEW K STATION <br />City Attorney Richard Meyers, Public Works/Community <br />Development Director Steve Thatcher and I recently met to <br />discuss the proposal by the Mounds View K Station on Highway <br />10 to remodel their facilities and the recommendation of the <br />City Planning Commission which included a recommendation to <br />revise the City's Comprehensive Plan. We are concerned that <br />any effort on the part of the City to piece -meal amend the <br />City's Comprehensive Plan to address a larger problem with <br />the Comprehensive Plan would simply jeopardize the <br />enforceability of the entire Comprehensive Plan. We feel <br />that it is necessary that the City undertake appropriate <br />evaluations of the Comprehensive Plan to determine whether <br />or not modifications of the Plan are appropriate and, if so, <br />to implement said modifications. <br />In order to provide the City with appropriate time to under- <br />take a study of the Comprehensive Plan and make any <br />necessary modifications, it will he necessary for the City <br />to implement some type of a moratorium on development in <br />those areas where conflict currently exists. Minnesota <br />statute 462.355 Subdivision 4, copy attached, provides that <br />a municipality may adopt ar. interim ordinance applicable to <br />all or part of its jurisdiction for the purpose of <br />protecting the planning process and health, safety and <br />welfare of its citizens by regulating, restricting or <br />prohibiting any use, development, or subdivision within the <br />jursidictior, or a portion thereof for a period not to exceed <br />one year from the effective date of an ordinance if the City <br />is conducting planning studies. Staff would recommend that <br />the Council adopt an interim ordinance prohibiting develop- <br />ment and subdivision of property fronting on Highway 10 in <br />planning districts 6 and 12, copy of map attached, for the <br />purpose of performing a study to re-evaluate the provisions <br />of the City's Comprehensive Plan regarding future <br />development of property fronting on Highway 10 in those <br />planning districts with the ordinance to expire 90 days <br />after its adoption. <br />Should the Council agree with this recommendation Staff <br />would be prepared to present an interim ordinance for its <br />first reading at the May 13, 1985 Council Meeting. <br />`/ DFP/mjs <br />Attachement: <br />
