STATEMENT OF REASONABLENESS <br />It is reasonable to update State Noise Standards to reflect <br />advances in noise pollution technology and research because the <br />legislation authorizing the original adoption of the standards <br />indicates the Minnesota Legislature's intention that the <br />standards reflect up-to-date scientific knowledge. The charge to <br />the Agency set forth in Minn. Stat. 5116.07, subd. 2 (1484) <br />requires that the standards be "premised upon scientific <br />knowledge as well as effects based on technically substantiated <br />criteria and commonly accepted practices." The express concern <br />with regard to scientific knowledge, which is continually <br />advancing and changing, suggests that the Legislature did not <br />intend the Agency to ignore these advances, but rather that the <br />standards would be periodically updated to take advantage of <br />improvements. <br />It is also reasonable to amend the rules to take care of <br />problems which have arisen over the years in the administration <br />
