The Agency <br />has found that the large number of land activities listed in the <br />existing rule made it more difficult to determine how a given <br />land area should be classified and some land areas could be <br />categorized in more than one land use activity. As a result of <br />this difficulty, the Agency is proposing to amend the rule to <br />simplify the list of land uses in NAC-1, NAC-2, and NAC-3. The <br />Agency is also proposing to eliminate NAC-4, which applied to <br />land where no activities are taking place. That type of land <br />under the proposed rule ammendents will continue to be subject to <br />no noise standard, since there are no receivers to protect. <br />The proposed Part 7010.0050 is divided into three subparts. <br />Subpart 1 provides that the Noise Area Classification is based on <br />land use activity at the location of the receiver and determines <br />the noise standards applicable to that land use activity unless <br />an exception is applied under Subpart 3. This language <br />represents a statement of the manner in which the Agency has <br />always used Noise Area Classifications. The reference to the <br />"location of the receiver" is an important addition to the rule, <br />however. In the past, the rule has never stated whether the <br />noise standard applied at the property line of the land area or <br />at the location of the receiver. The Agency has interpreted the <br />existing rule so as to apply the standard at the location of the <br />receiver, and this approach is continued in the proposed new <br />
