Because the purpose of setting noise standards is to <br />protect the people who receive the noise, it is reasonable to <br />apply the standard at that location. <br />Subpart 2 of the proposed rule sets forth the activities <br />included in each of the three Noise Area Classifications. ;N04114 <br />Area classification 1 �nclgdes the following land use <br />activities: xesideptial, educational, - medical, dedicated nature, <br />areas,lnontransient housing,;-schooIs,'churches, medical <br />facilities providing nighttime care, and nature preserves. <br />Noise Area ClassificatioA 2) includes the following land use <br />activities: commercial, entertainment and recreationalr-offies <br />buildings,, rgtgil storfp,, 4erwices, transient• lodginge,madicaI <br />facilites not providing nighttime care, parks, and athletio <br />fields. Noise -Area Classification 3 includes the following land <br />act vities:,industrial ,,manufacturing, utilitie9, <br />use <br />transportatlgn, and agricultural. This represents a <br />simplification of the existing rule and not a change in the basic <br />thrust of the land activity categories listed in the existing <br />rule. it is reasonable to simplify the list of land use <br />activities because the Agency believes that this will resule in <br />fewer cases where a land use activity could arguably fall into <br />two different Noise Area Classifications. <br />Subpart 3 of the proposed rule, entitled "exceptions," <br />provides that the Noise Area Classification for a land use may be <br />
