Four <br />exception provisions are included. <br />Subpart 3, Item A provides that daytime standards for Noise <br />Area Classification 1 shall be applied to Noise Area <br />Classification 1 during the night time if the land use activity <br />does not include overnight lodging. This proposed rule does not <br />represent any change from the existing rule. See Minn. Rule Part <br />7010.0700, Item B. Because the nighttime noise standard for <br />Noise Area Classification 1 is set to protect the ability of <br />people (receivers) to sleep during those hours, it is reasonable <br />to apply the less stringent daytime standards to nighttime hours <br />if there are no people sleeping in a given land area to be <br />protected. <br />Subpart 3, Ttem B provides that the standards for a building <br />in a Noise Area Classification 2 shall be applied to a building <br />in a Noise Area Classification 1 if the following conditions are <br />met: <br />1. The building is constructed in such a way that the <br />exterior to interior sodnd level attenuation is at least <br />20 dBA. <br />2. The building has year-round climate control. <br />3. The building has no areas or accommodations contiguous <br />to it that are intended for outdoor activities. <br />The rationale behind this rule relates to the fact that a <br />building with the right characteristics can protect people <br />against additional noise, and therefore a less stringent noise <br />standard can be applied to the area where that building is <br />
