-33- <br />(d) the establishment of performance standards for small <br />businesses to replace design or operational standards <br />required in the rule; and <br />(e) the exemption of small businesses from any or all <br />requirements of the rule. <br />The proposed amendments may affect small businesses as <br />defined in Minn. Stat. 514.115. As a result, the Agency has <br />considered the above -listed methods for reducing the impact of <br />the rule on small businesses. Because there are no reporting <br />requirements in the rule, no accommodation for small business was <br />possible in that regard. The Noise Area Classification system <br />does take into account businesses as a whole by setting less <br />stringent standards for areas where the land activities are <br />commercial and industrial. However it is not possible to take <br />business size into account, Since the standards are set to be <br />protective of health and welfare. Therefore the Agency has <br />determined that no specific exemptions for small businesses can <br />be xadB. <br />VI. CONCLUSION <br />Based on the foregoing, the proposed amendment of the State <br />Noise Standards, by adopting Minn. Rules Parts 7010.0010 through <br />7010.0070 and by repealing Minn. Rules Parts 7010.0100 - <br />
