/�• 9.1 (continued) <br />this Agreement, the prevailing party shall be entitled, in <br />addition to costs of suit, to reasonable attorney's fees <br />incurred in connection with any such claim, proceeding or <br />action and the same may be awarded by the court having <br />jurisdiction of such claim, proceeding or action. <br />ARTICLE 10 <br />INDEMNIFICATION <br />The Fire Department shall indemnify and hold harmless the <br />City from any claim, suit, demands or causes of action <br />arising out of loss or damage caused to a person or <br />property by reason of any acts, omissions or negligence on <br />the part of the Department or its members in the performance <br />of the contract. <br />ARTICLE 11 <br />BENEFIT <br />11.1) This Agreement shall be binding upon and insure to <br />the benefit of the successors of the City and the Fire <br />Department. <br />ARTICLE 12 <br />NOTICES <br />12.1) Any notice required or permitted to be given under <br />this Agreement shall be given in writing, and shall be sent <br />by mail to the registered address of the Fire Department or <br />the Administrative Office of the City. <br />- 9 - <br />
