26.14 <br />(3) A separate Improvement fund shall be set up for each <br />of the enumerated survices referred to in Subdivision ' <br />1 and financed under this Section. Proceeds of <br />special charges as well as special assessments and <br />taxes shall be credited to such improvement fund. Any <br />balance of the proceeds of any obligations remaining <br />therein may he used to pay the cost, in whole or in <br />part, or any other improvement instituted pursuant to <br />Liens Chaplet ut may lie transferred to the fund <br />established under Chapter 20.01. <br />26.15 <br />26.15. CHARTER e+ROVISIONS, EF1'ECT. Local improvements <br />shall be carried out exclusively under the provisions of the <br />Charter. <br />26.16. SPECIAL ASSFSSMENTt GOVERNMENTAL UNITS. <br />Subdivision 1. Authority to Assess. The City may levy <br />special assessments against the property of a governmental unit <br />benefited by an improvement to the same extent as if such pro- <br />perty were privately owned, but no such assessments, except for <br />storm sewers and drain, systems, shall he levied against a <br />governmental unit for properties used nr to be used for highway <br />rights of way. A "governmental unit" means a county, city, <br />public corporation, or a school district. If the amount of any <br />such assessment, except one against property of the state, is not <br />veld when due, it may Lee tecovered in a civil action Drought by <br />the City against the governmental unit owning the property so <br />assessed. <br />Subdivision 2. Determination. in the case of property <br />owned by the state or any fnstrumentality thereof, the Council <br />may determine the amount that could have been assessed had th, <br />land been privately owned. Such determina a on shall b^ made only <br />after the Council has held a ;tearing on the proposed assessment <br />after at least two weeks notice of the hea,ing has been given by <br />registered or certified mail to the nead of the instrum_ntality, <br />department or agency having jurisdiction over- the property. The <br />amount thus determined may be paid by the instrumentality, <br />department or agency from available funds. If no funds are <br />available, and such instrumentality, department or agency is <br />supported in whole or in part by appropriations form the general <br />revenue tuna, then it shall includa in its next budget request <br />the amount thus determined. No instrumentality, department or <br />agency shall be bound by the determination of the Council and may <br />pay trom available funds or recommend payment in such lesser <br />amount as it determines is the measure of tice benefit received by <br />the land from the imprnvement. <br />Subdivision J. Exclusiveness. This section shall not <br />modify any law authorixiny the imposition of special assessments <br />against governmental units. <br />
