Any person <br />whose name appears on a petition to the Council for a local <br />improvement, or on a petition to the Council against a local <br />improvement, may withdraw his/her name by a statement in <br />writing tiled with the Council lxfore such petition is <br />rroconred to the Council. <br />- <br />Subdivision 2. Protest Petition. Reyardless of <br />the provisions in Subdivision 1, when less than 100 percent <br />of the estimated cost of a proposed local improvement is to <br />he paid for by special assessment, within the sixty-day <br />period after a public hearing has been held or, the proposed <br />improvement, a petition may be filed with the Council, <br />signed by a na)ority of the number of electors who voted for <br />Mayor in the last regular municipal election, protesting <br />against either the improvement, or the assessment formula, <br />or both. In this event, the Council shall not proceed with <br />the improvement, as proposed. <br />Subdivision 3. Limitations. When a proposed <br />improvement is disallowed under the foregoing subdivisions, <br />the Council may proceed at any time between sixty days and <br />one year after the pubi, hearing on the improvement. ' <br />However, no contract shall he let in the event that the <br />current proposed contract e•cceeds the estimated cos: by more <br />than 10 percent. <br />Subdivipion 4. ReConSid,,raLiOnS, When a proposed <br />improvement is disallowed under the foregoing subdivis,ons, <br />the Council shall not vote on the same improvement within a <br />period of one year after the public hearing on sai6 improve- <br />ment. <br />Subdivision 5. Petition ty All Owners. Whenever all <br />as <br />owners of real property 35utting upon any street <br />theaCouncil <br />the location of any improvement shall pftition - <br />to construct the improvement and to asse?a the entire cost <br />against their property, the Council may, after a public <br />hearing, as provided in Chapter 9 of the Home Rule Charter <br />adopt a resolution deteririninr, such facts end ordering the <br />improvement. <br />26.06 Improvements, Petition. When any petition for <br />the making of any public improveient or in opposition to any <br />public improvement as provided for in this Code, i solution, <br />presented to the Council, the Council shall, by <br />determine whether or not the petition has been signed by the <br />required percentage of owners of property affec'ed thereby, <br />or as to the sufficiency of said petition. <br />
