26.07 <br />26.07 Appeal From Determination Of Legality Of <br />Petition. Any person, being aggrieved by this determina- <br />tion, may appeal to the district court of Ramsey County by <br />serving upon the Clerk of the Muniripality, within thirty <br />days after the adoption '>f the resolution, a notice of <br />appeal briefly stating the grounds of appeal and giving a <br />bond 1n the penal sum of $250.00, in which the Municipality <br />.hail he named as ohligee, to be approved by the Clerk of <br />the Municipality, conditioned that the appellant wiii uuly <br />prosecute the appeal, pay all costs and disbursements which <br />may be zdjudged against him/her, and abide by the order of <br />the court. The Clerk shall furnish the appeallant a <br />certified copy of the petition, or any part thereof: on <br />briny paid by appellant of Lha pr.nper charges therefor. <br />The appeal shall be placed upon the calendar of the next <br />general ter:L commencing more than thirty days after the date <br />of serving the notice and filing the tx>rid and shall be tried <br />as are other appeals in such cases. Unless reversed upon <br />the appeal, the determination of the Council as to the <br />sufticiency of the petIrion shall he final and conclusive. <br />26.08 Council Procedure. <br />subdtvis u,n 1. Plans and Specifications, Advertisement <br />For Bids. When the Council determines to make any improve- <br />ment it shall cause plans and specifications of the improve- <br />ment to be made, or if previously made, to be modified, if <br />necessary, and to be approved a^d filed with the Clerk, and <br />if the estimated Cnst exceeds $10,000, shall advertise for <br />bids for the iml-rovement in the newspaper and such other <br />paters and for such length of time as it may deem <br />advisable. if ttie estimated cost exceeds $100,000, <br />publication shall be made once in the newspaper and at least <br />once in a newspaper or trade paper published it a city of <br />the first class no less than three weeks before the last day <br />for sut3mission of nids. To be elloible as such a trade <br />paper, a publication shall have all rha qualifications of a <br />legal newspaper ex•'ept that instead of the requirement that <br />it shall contain general and local news, such trade oi.per <br />shall contain buildiiq and construction news of interest to <br />contractors in this state, among whom it shall have general <br />circulation. The advertisement shall specify the work to be <br />done, shall state the time when the bids will be publicly <br />nprned for consideration by the Council, which shall he not <br />less than ten days after the first publicatinn of the <br />advertisement when the estimated cast is less than $100,000 <br />am not less than three weeks after such publication in <br />other cases, and shall state that no bids will be considered <br />unless sealed and filed with the Clerk and accompanied by a <br />cash deposit, cashier's check, bid bond, or certified check <br />payable to the Clerk, for such percentage of the amount of <br />h` CounC.) may specify.
