116.01 <br />rCHAPTER 116 <br />ITINERANT AMUSEMENT RIDES, CARNIVALS, CIRCUSES <br />116.01 License Required. No person, firm or corporation <br />shall operate, maintain, or exhibit any itinerant amusement <br />rides, carnival or circus within the municipality without first <br />r,btalniny a license as provided in this chapter. <br />116.02 Application and Issuance. <br />Subdivision 1. Application. An application for such <br />iicense shall be made in writing to the Clerk -Administrator and <br />shall state the full name and address of the applicant, the loca- <br />tion where the amusement rides, carnival or circus is to be <br />conducted, the owner of the premises, and such other informs a on <br />as shall be required by the Clerk-Administratut. <br />Subdivision 2. Review and Approval. the clerk -Adminis- <br />trator shall verify the information supplied in the application <br />and conduct such investigation as required by the Council of the <br />applicant, proposed activities, and premises. The Council shall <br />require review and recommendation from the Fir-- marshal* <br />/► Inspector and poliee chief before the license is granted. The <br />i council may require a public hearing on the application, and such <br />F hearing shall be held at such time and upon such notice as the <br />Council may determine. The Council may grant or refuse to grant <br />the license after consideration of the application. <br />Subdivision 3. Conditions. The Council may impose any <br />conditions or restrictions it deems necessary or advisable in the <br />public interest, inclu.iiny but not limited to conditions relating <br />to the hours of operation, the outside light,ny of the premises, <br />and parking facility. The Council may also reserve the right to <br />impose any cond±lions or restrictions at any time after the <br />issuance of a license hereunder. A bond may be required in such <br />form and amount as specified by the Council to guarantee com- <br />pliance with such conditions as shall be nerein imposed. <br />116.03 License Fees. The fee for every such license <br />shall be established by resolution of the City Council and shall <br />be paid at the time application is submitted to the Clerk - <br />Administrator. If the Council denies an application for license, <br />the Clerk -Administrator shall refund the license fee after de- <br />ducting $25.00 for the costs of processing the application. <br />116.04 Insurance. <br />(1) The licensee shall obtain and keep in full force and <br />' effect proper insurance coverage to protect the municipality and <br />said licensee against any liability for personal injury or <br />
