Pauley, Clerk-Adminstrat <br />DATE: June 26, 1985 <br />RE: Fair Labor Standards Act <br />Effective Date: April 15, 1985 <br />Covered Employees: Except for employees considered to be <br />executive, administrative or professional, <br />all employees are covered by the Act. <br />Based upon the best information currently <br />available, the following employees have <br />been determined to be exempt. <br />Executive - Clerk -Administrator <br />Department Heads <br />Administrative - Recreation Supervisor <br />Sergeant/Juvenile Officer <br />Administrative/Professional - <br />Public Works Foreman/ <br />Building Inspector <br />Professional - Accountant <br />Also, exempted from the provisions are <br />seasonal recreational employees of facili- <br />ties not in operation for more than seven <br />months in any calendar year. In the case <br />of Mounds view, this applies to all of the <br />City's recreational facilities except for <br />Edgewood Pool. <br />It should be pointed out, however, that <br />this conclusion is valid only as long as <br />parks maintenance is performed by employees <br />assigned to a department other than Parks, <br />Recreation, and Forestry. <br />Requirements: Except for exempted employees, all employees <br />must be paid the minimum wage, $3.35/hour, <br />and receive overtime wages for hours worked <br />in excess of a specified number during a <br />work week or work period. <br />As all non-exempt employees receive a wage <br />in excess of $3.35/hour, the City is in <br />compliance with the minimum wage standard. <br />In the case of the overtime requirement, <br />�.� the City can comply, but will need to <br />address certain issues and make changes <br />to its current operations, procedures, and <br />policies. <br />
