any manner which shall be inconsistent with the provisions <br />r. of any previous contracts outstanding on the property in <br />which the Seller herein is a party, or in the event that <br />the sale is being treated by the Seller as an installment <br />sale for income tax purposes. The balance due shall be <br />secured by a Financing Statement, Security Agreement and <br />Note to be executed at the time of closing. Said Note shall <br />be personally guaranteed by the Buyer. <br />In addition, Seller agrees to execute and deliver a Bill <br />of Sale covering the fixtures, equipment, furniture, appliances <br />and personal property to be described in "Exhibit V . It is <br />acknowledged that said property is included in the sale herein, <br />but shall regain as collateral security for performance by Buyer. <br />It is further acknowledged that title to said personal property <br />is also pledged as collateral security for performance under <br />that certain Agreement dated January 3, 1983, by and between <br />D 6 M Investments, Inc. and Seller; and under that certain Contract <br />for Deed dated SepteMber 18, 1981, by and between Albert J. <br />Hartinger, Kathleen E. Hartinger and A b J Realty, Inc. as vendors <br />and D 6 M Investments as vendee; and under that certain Agreement <br />dated Au.Just 29, 1979, as am�nled on Septemr,er 18, i.981, betwee.i <br />Joseph F. Hartinger and A 6 J Realty, Inc. ana Albert J. <br />Hartinger. <br />3. Buyer acknowleelges that they have inspected the buildings, <br />structures, improvements, furniture, fixtures, appliances, <br />equipment and personal property being sold hereunder; and that <br />they accept the personal property in its "as is" condition without <br />any further obligations on the part of Seller, except to deliver <br />the premises and all appliances, heating, air conditioning, <br />coolers, wir.ng and plumbing used and located on said premises <br />in good working order at the date of closing. <br />-2- <br />
