MOUNDS VIEW PLANNINU CUMMISSIUN <br />RESOLUTION NO. 131-85 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RECOMMENDATION 'ro THE CrrY COUNCIL I<EGARDING MOUNDS VIEW <br />PLANNING CASE 168-85, iiERDST AND SUNS DF,MOLrTIUN COMPANY <br />WHEREAS, Herbst and Sons Demolition Company has requested <br />City approval to construct a building additlnn Jr) their existing <br />buildiny in the Pity of Mounds View; and <br />WHEREAS, construction of this addition, as requested, <br />requires approval of the development, major subdivision, <br />rezoning, and variance; and <br />WHEREAS, the Planning Commission has reviewed the staff <br />report and reviewed information submitted by the applicant which <br />includes the f,.Iiowing: <br />1. Developme.•t plan <br />2. Preliminary plat site survey <br />3. Evidence of site control; and <br />WHEREAS, the Planning Cormnisgion has also reviewed the <br />proposal and it is in conformance wlLn all Chapters of the <br />Municipal Code, specifically Chapters 4U, 42, 4V, anu 49A ane <br />Sta^_e Statutes; and <br />WHEREAS, this development has been submitted to the Rice <br />Creek Watershed District for their approval; <br />WHEREAS, the existing building is 5 feel from the property <br />line, and the City Code :e.,.lres a 20 foot setback from side yard <br />lot lines and this is a pre-existing condition not caused by the <br />property owners; <br />NOW, THEREFURE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends approval of the major subdivision; <br />LIE IT FURTHER RESOLVED that tlir Mounds View Planning <br />Commission recommends rezoning the property from B-3 to I-1; <br />BE IT FURTHER RCSOLVED that the Mounds View Planning <br />Commission recommends that the property now occupied by Pettibone <br />Corporation bu rezoned from D-3 to I-1 at the same time; <br />ISE I'r ir'URTIIKR RESOLVED that the Mounds View Planning <br />Commission grants a variance of 15 feet on the side yard setback <br />requirement; <br />
