WINE AND NON - <br />INTOXICATING BEER LICENSE APPLICATION <br />As you will recall, at the April 28th Council Meeting the <br />City Council set a puhlic hearinq date of 7:10 p.m. <br />May 27, 1986 to consider the above referenced application. <br />In reviewing the details of this application, Staff <br />determined that the New Peking Restaurant is less than 500 <br />feet from the property line for Sunrise Methodist Church. <br />Chapter 100.07 (3) states, "No license shall be granted <br />within 500 feet of the property line of any school or church <br />located in Mounds View." As a result of this determination <br />and as a courtesy to the applicant, I advised him of this <br />findino and indicated that it would be unlikely for a <br />license to ne issued in consideration of this finding unless <br />the Code was amended. In view of this information, the <br />applicant, Mr. Louis Yuk Leung Lau, requested that his <br />application be withdrawn and the prepaid license fees <br />refunded. Staff would recommend Council ranrel the <br />previously scheduled public hearinq and authorize refund of <br />his license fees. <br />RECOMMENDATION: Staff recommends Council camel the public <br />hearinq scheduled for 7:10 p.m. cn May 27, 1986 for <br />consideration of the New Peking Restaurart On -Sale Wine and <br />Non-Intoxicatinq Beer Liquor Licenses and refund the prepaid <br />license fees of o1,650. <br />DFP/mjs <br />
