It is my understanding and the City <br />Attorney': understanding that the ditch falls within <br />the jurisdiction of your Watershed District powers. <br />It is my belief that such conditions, while posing a <br />hazard to the public at the present time, could in fact <br />rosult in some injury or damages to certain citizens <br />within the. City. As a result: I am requesting, on <br />bohalr of the City of. Mounds View, that you take <br />whatever st.eps are necessary to remove these <br />pntential.ly hazardous conditions to ensure the safety <br />o" the citi.zens of Mounds View. It is my understanding <br />that this responsibility has been delegated to your <br />WAtot-shed District pursuant t:o Minne.,sota statute <br />Section 112.43, Subd. 3. If this Is not done, Rice <br />Creek Watp.vrhed District would he liable for injuries <br />or damages resulting from lack of ditch repair. <br />Therefore, the City of Mounds View cannot he held <br />liable for inurins or damages resulting rrom lack of <br />ditch repair. <br />x <br />Attachment #3 <br />
