MEMO TO: MAYOR AND CITY COUNC <br />FROM: CLERK -ADMINISTRATOR J} <br />DATE: SEPTEMBER 17, 1986 <br />SUBJECT: ELECTION JUDGE ELIGIBILITY REQUIREMENTS <br />As a result of the discussions at the September 8 Agenda <br />Session regarding the aforementioned subject matter, Staff <br />wishes to submit the following information regarding <br />Minnesota Election Law requirements relating to the <br />qualifications and eligibility of individuals to serve as <br />election judges. Attached for your information please find <br />Section 204B.19, Subdivisions 1 -5 outlining the <br />qualification requirements in the Minnesota Election Laws of <br />1983, updated 1986. Essentially, the Law allows that any <br />individual who is eligible to vote in an election precinct <br />is qualified to be appointed as an election judge assuming <br />the individual is able to read, speak and write the English <br />language, is not a spouse, parent, child, or sibling of any <br />election judge serving in the same precinct or any candidate <br />at that election, or is sot a candidate themselves at that <br />election. The Law further provides that the appointing <br />authority, the Mounds View City Council, may establish <br />additional requiremant qualifications which are not <br />inconsistent with the Law and which relate to the ability of <br />an individual to perform the duties of an election judge. <br />As it relates to requiring election judges to sign <br />statements attesting to their political party affiliation, <br />the Law defines in Section 200.02, Subdivision 17 that a <br />member of a major political party shall be one who: _ <br />a. Supports the general principles of that <br />party's constitution; <br />b. Voted for a majority of that party's candi- <br />dates in the last General Election; or <br />c. Intends to vote for a majority of that ^a <br />party's candidates in the next General <br />Election. <br />Should the Council wish to require election judges sign a <br />statement indicating that they are a member of one of the <br />major political parties, the definition stated above must be .. <br />included in that form. <br />Although some discussions have occurred between myself and <br />members of the Council regarding the specific eligibility Of <br />certain election judges and the distribution of election <br />judges among the two political parties, I am not aware of <br />any specific violations or other events that have occurred <br />U <br />
