NING <br />MOUNDS <br />RESOLUTION NNO. 174-86SSI0N <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />DING <br />CASE <br />NOFC0184-86, RED OAKIIPARK T(RED OAK LDRIVERAND SHERWOODCROAD) <br />WHEREAS, Mr. Chuck Cook has requested City approval of a <br />major subdivision; and propertyinto 16 <br />WHEREAS, the request is se subdivide the ment for a detention pond over a <br />lots and to grant a drainage ease <br />portion of lots 81 9 and 10; and <br />WHEREAS the preliminary plat satisfies all City Code <br />requirementr, including Chapters 40, 42, 48, 49, 49A and State <br />statutes; and <br />WHEREAS, the development will be reviewed and approved by <br />Lhe Rice Creek Watershed District (RCWD) prior to construction; <br />and <br />WUr•.REAS, there is no wetland or flood plain located on the <br />subdivisiosn; and <br />al meeting was held on January 29, <br />WHEREAS, an information <br />_ 1986; and <br />WHEREAS, the minimum setback on the east side of Red Oak <br />Drive between Sherwood Road and Ardan Avenue is 54 feet; and <br />WHEREAS, the existing house on the southeast corner of <br />Sherwood Road and Red oak Drive has a setback of 44 feet from the <br />Red Oak Drive lot line; and <br />WIIF.REAS, the Developer requests a 10 foot variance from <br />the Red Oak Drive side yard setback requirements for Lot No. 2; <br />and <br />tCIIBREAS, the hardship is that the lot will not be <br />buildable without the variance; and <br />WHEREAS, Lhere are unique circumstances which apply to <br />Lhis property; and <br />rcumstances do not result from the <br />WHEREAS, the special ci <br />actions of the applicant; and <br />t71IER1•;AS, granting a variance request will not confer on <br />the applicant any special priviledges; and <br />
