RED OAK PARK <br />DEVELOPMENT AGREEMENT NO. 86-78 <br />EXHIBIT 2A <br />In addition to the foregoing conditions, the developer agrees to <br />the following: <br />City: <br />1. Payment of all City administrative expenses above and <br />beyond amounts previously submitted. <br />2. Temporary occupancy permits shall be issued with the <br />condition that all special assessments be paid within 60 <br />days and paid prior to the City issuing the final <br />occupancy permit. <br />3, Pay a park dedication fee of $840.00 prior to the City's <br />approval of the subdivision. <br />4. Obtain City approval of the final plat and provide <br />evidence of recording of said plat at Ramsey County prior <br />to submitting building applications. <br />5. Prior to preparing plans and specifications, sign a <br />petition stating that the developer is the 100 percent <br />owner of the benefitted property and that he petitions <br />the City for the public improvements and that he will pay <br />for the cost of preparing the feasibility study, plans, <br />specifications, and other construction work. Tnis item <br />shall be accomplished by January 1, 1,987 (Attachment W . <br />6. Prior to the City awarding the construction contract, the <br />Developer shall do the following: <br />a) Sign an agreement which allows the City to specially <br />assess his property without public hearing and the <br />owner hereby waives all of the Charter, Municipal and <br />Statutorial requirements to enable the City to <br />certify an assessment to the Ramsey County Auditor's <br />office and the owner hereby agrees to allow the City, <br />by its own action, to assess the above described <br />property (Attachment 92). <br />b) Furnish a security to secure assessment payments for <br />three years (assessment will be approximately 8 <br />percent interest for 10 years). <br />7. The Developer shall remove any accessory buildings, <br />existing playground equipment, existing sidewalk, <br />existing bituminous, and other miscellanous equipment <br />from the site by July 1, 1987. <br />Developer: <br />
