12/29/88 [REVISOR ] XX/MC 89-0652 <br />1 <br />$1000, whichever is greater; or 1 <br />2 <br />(2) cancel or rescind a transaction that the board finds <br />3 <br />was substantially influenced by a violation of this chapter if <br />4 <br />the cancellation or recision is in the interest of the public <br />5 <br />and the public's interest outweighs any adverse affect the <br />6 <br />cancellation or recision might have on the interests of an <br />7 <br />innocent third party. <br />8 <br />(b) Damages recovered by the board in a civil action under <br />9 <br />this subdivision must be used as follows: <br />10 <br />(1) the governmental unit or units affected by the <br />11 <br />violation must, to the extent. possible, be reimbursed for any <br />12 <br />losses; and <br />13 <br />(2) any additional damages must be deposited in the general <br />14 <br />fund. <br />15 <br />Sec. 5. [10B.05) [FINANCIAL DISCLOSURE.) <br />16 <br />Subdivision 1. (APPLICATION.] A public official shall file <br />17 a statement of financial interest In accordance with subdivision <br />18 2 with respect to all the cats cries of information regu.ired by <br />19 subdivision 3. A person employed by the state university syetem <br />20 or the community college system in a position included in the <br />21 definition of "teacher" under section 354.03. subdivision 2, <br />22 shall file a statement of financial disclosure with respect to <br />23 the categories of information in subdivision 3 expressly <br />24 covering such a person. <br />25 Subd. 2. [STATEMENTS OF FINANCIAL INTEREST.] A persor who <br />26 on the first Monday in January of a year is covered by <br />27 subdivision 1 shall. file a statement of financial interest with <br />28 the board by April 30 of that year. A person who becomes <br />29 covered by subdivision 1 after the first Monday in January of a <br />30 year shall file a statement with the board within 30 days of the <br />31 date on which the person became covered or by April 3_:, <br />32 whichever is later. The statement must be on a form prescribed <br />33 by the board and signed by the official or other person. It <br />34 must contain the information required by subdivision 3 for the <br />35 preceding calendar year, as of December 31 of that year. <br />36 Subd. 3. (CONTENTS.)
