12/29/88 (REVISOR ) XX/MC 89-0652 <br />1 disciplinary action or reprisal prohibited by this subdivision, 10 <br />2 the board shall report the matter to the attorney general or the <br />3 appropriate county attorney Eor the initiation of a criminal <br />4 proceeding. <br />5 Subd. 8. (FALSE COMPLAINTS PROHIBITED.) A person who <br />6 knowingly makes.a false or bad -faith complaint or report of an <br />7 alleged violation of this chapter is Guilty of a misdemeanor. <br />8 Subd. 9. [LATE FILINGS; FAILURE TO FILE.) The board, by <br />9 certified mail or personal service, shah notify a person who <br />10 has not yet filed a statement or report required by section 5 or <br />11 6 seven days ar'ter the filing date imposed by section 5 or 6. <br />12 If the person fails to file the statement or report within sever, <br />13 days after receipt of the notice, the board may impose a late <br />14 filing fee of $50 a day, not to exceed $1,000 in total, <br />15 commencing on the eighth day after receipt of the notice. The <br />16 board, by certified mail or personal service, shall further <br />17 notify a person who has not filed a statement or report required <br />18 by section 5 or 6 within 21 days after receipt of the first <br />.19 notice under this subdivision- that the person may be subject to <br />20 a criminal penalty for fait >o file the statr..ant og report. <br />21 A person who fails to file a statement or report with the board <br />22 within seven days_after receipt of the second notice is guilty <br />23 of a misdemeanor. <br />24 Subd. 10. [PENALTY FOR FALSE. STATEMENTS.) A statement or <br />25 report required by section 5 or 6 must be signed and certified <br />25 as true by the Person required to file the report. A_person who <br />27 signs a statement or report and certifies it to be true knowing <br />28 tnat it contains false information or woo knowingly omits <br />29 required information, is guilty of a gross misdemeanor. <br />30 Subd. 11. [OTHER REMEDIES.] (a) In addition to the other, <br />31 procedures and remedie• authorized by this section, the board <br />32 may; <br />33 (1) bring civil action against a person who has gained <br />34 economic advantage through a violation of this chapter and m�y <br />35 recover, on behalf of the governmental unit or units affected <br />36 the violation triple the amount of the economic advantage or <br />10 <br />
