.1/� IJ7 yy <br />ORDINANCE NO. 467 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW <br />BY AMENDING CHAPTER 101 ENTITLED, "NON -INTOXICATING LIQUOR" <br />The City Council of the City of Mounds View does <br />hereby ordain: <br />SECTION I. Chapter 101.02 is amended by adding the <br />following: <br />(4) A holder of an "on -sale' license to sell non - <br />intoxicating malt liquor pursuant to 101.02, (2); who is <br />also licensed to sell "on -sale" wine pursuant to Chapter <br />101.02, Subdivision 6; and whose gross receipts are at least <br />sixty percent (60%) attributable to the sale of food, is <br />permitted to sell intoxicating malt liquor at "on -sale" <br />without an additional license. <br />SECTION II. Chapter 101.03 is amended by adding the <br />following: <br />Subdivision 2. Applications for a license to sell <br />intoxicating malt liquor "on -sale" pursuant to the require- <br />ments of 101.02, (4) shall include documentation to <br />substantiate food sales equal or exceeding sixty percent <br />(60%) of gross receipts for the 12 month period of November <br />1st through October 31st preceeding the license issuance <br />date. Documentation shall be by statement of a certified <br />public accountant based upon an audit of sales receipts or <br />other certifiable records of the business in connection with <br />which the proposed license will operate. <br />SECTION III. Chapter 101.04, (3) is amended by <br />adding the following: <br />(a) No additional license fee shall be required <br />of a licensee who sells intoxicating malt <br />liquor "on -sale" pursuant to the requirements <br />of 101.02, (4)- <br />SECTION IV. This ordinance shall take effect thirty <br />days after the date of its publication. <br />Read by the Council of the City of Mounds View on <br />this of , 1989. <br />
