MAYOR AND CITY COUNCIL <br />JUNE 7, 1989 <br />PAGE TWO <br />Robert's Off 10 - As of June 6, 1989, Robert's Off .10 is in <br />arrears on the payment of utility billings in the amount of <br />$871.76 for the 4th Quarter of 1988 and 1st Quarter of 1989. <br />A certificate of insurance was not provided with the application <br />for renewal and has not been submitted to tha City as of the date <br />of this memorandum. <br />Staff has been led to believe by Mr. Waste's daughter, who claims <br />site is the cook for Robert's Off 10, that the only food being <br />served on Sundays is hot dogs. Staff has been unable to perform <br />a Sunday inspection due to the business being closed on the past <br />Sunday. Staff intends to conduct the inspection on Sunday, <br />June llth. <br />Depending upon the results of the inspection, staff will have one <br />or more recommendations. They are, <br />1. Renewal of the on -sale intoxicating liquor license <br />conditioned upon payment of past due utility billings and <br />receipt of a certificate of insurance no later than <br />June 3U, 1989. <br />2. If the requirements for food on Sundays is not being met, <br />denial of the renewal of Sunday sales authorization. <br />Another problem that exists with the license and future renewal <br />is the fact that Mr. Waste has interest i,l the Loose Ends On 10 <br />intoxicating liquor license due to his ownership of the <br />building. Chapter 100.06, (2), (f) of the City Code prohibits the <br />issuance of a license to an individual, "Who has an interest <br />directly or indirectly in any other establishment in the <br />municipality to which a license of the same class has been issued <br />under this chapter." In the past this problems was resolved when <br />Mr. Waste's interest in the Loose Ends building was placed in <br />Mrs. Wasta's name. Due to the untimely death of Mrs. Waste, this <br />is no longer possible and M:. Waste has been reminded of the <br />problem and advised to resolve the matter. City Attorney Kerney <br />will offer his opinion regarding this situation Monday evening. <br />Donatelle's Supper Club - The applicant complies with all code <br />and statutory requirements. Staff recommends renewal of the <br />on -sale intoxicating liquor license and authorization for Sunday <br />sales. <br />Mermaid Cocktail. Lounge, Inc. - The applicant complies with all <br />code and statutory requirments. Staff recommends renewal of the <br />on -sale intoxicating liquor license and authorization for Sunday <br />sales. <br />
