jl&,h � l9 <br />TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK-ADMINISTRATO <br />DATE: JULY 17, 1989 <br />SUBJECT: PROGRAM AVENUE ROAD RIGHT-OF-WAY <br />As you may recall, the City has been negotiating with <br />Mr. Russ Underdahl regarding the purchase of property owned <br />by Mr. Underdahl for Program Avenue right-of-way. <br />Under the advice of City Attorney Kerney and with the <br />approval of Everest Development, a settlement of this <br />dispute was reached in the amount. of $15,000. This price <br />was agreed to in lieu of the City proceeding with condemna- <br />tion and incurring expenses in excess of the additional <br />$5,000 being paid to the Underdah'_s for this right-of-way. <br />Attached please find a letter from City <br />Attorney Mr. and Mrsnerequesting that the City make payment <br />Under- <br />dahl for the agreed upon amount. <br />Staff requests Council approval of this settlement and <br />payment of the $15,000 to Mr. and Mrs. Underdahl. <br />DFP/MJS <br />
