v6-In", /a <br />CMAYOR & CITY COUNCIL <br />FROM: CLERK -ADMINISTRATOR PAUL <br />DATE: August 18, 1969 <br />SUBJECT: STATE LIQUOR LAW AMENDMENTS <br />During the regular Session of the Legislature in 1989, several <br />amendments were made to the State"s liquor laws. Of these, three have a <br />direct impact upon the City"s liquor codes. These Statutory changes and <br />the current requirements of the City Code are as follows. <br />1. State law was amended to allow the sale of intoxicating liquor <br />on Sundays for appropriately licensed establishments from Noon <br />to 1:00 a.m. City Code reflects the old Statutory requirements, <br />namely, Noon to Midnight. <br />2. State law was amended to allow the sale of intoxicating liquor <br />on January 1st and July 4th. City Code contains the old <br />requirement that liquor sales are prohibited on these days. <br />3. The final change in State Law requires that a Public Hearing <br />rprecede any increase in fees for liquor licenses and that all <br />`�.. affected licensees be notified by mail at least 30 days before <br />the hearing. The City Code allows for changes in liquor license <br />fees by resolution of the City Council with no requirement for a <br />public hearing. <br />In the case of items 1 and 2, staff would request Council direction. <br />If you wish, you may leave the City Code as is and be more restrictive <br />than the State law. Staff will be preparing an amendment to Chapters <br />100 and 101 of the Code to reflect the requirements of item 3 and will <br />include any changes needed to comply with your direction on items 1 and <br />2. <br />f <br />
