ITEM 6 <br />MEMO TO: Mayor and City Council <br />FROM: City Planner Hren <br />DATE: September 28, 1989 <br />SUBJECT: MOUNDS VIEW SQUARE - HARDEES <br />PLANNING CASE No. 276-89 <br />Please find attached a memo from Administrative Secretary Michele <br />Severson to myself regarding carnival licenses, health fairs and <br />Christmas tree sales as they relate to the Mounds View Square <br />shopping center. <br />The Planning Commission discussed Paster Enterprises' proposal <br />for the Hardees Restaurant and an issue that was raised was the <br />carnivals, health fairs and Christmas tree sales. The Planning <br />Commission questioned whether it was appropriate to continue <br />allowing these types of activities should the Hardees be <br />constructed on the site. The City Code addresses carnivals and <br />Christmas tree sales in Chapters 110 and 116, both are attached <br />for your review. These are the only criteria that an individual <br />would have to meet in order to allow such use provided they have <br />approval by the property owner. The Zoning Code does not address <br />temporary uses and as such, does not regulate or evaluate <br />proposals such as carnivals, health fairs and Christmas tree <br />sales. <br />If you have any futher questions on this matter, please feel free <br />to call myself or Administrative Secretary Michele Severson. <br />MMH/BAC <br />060 <br />
