WHEREAS, this road project had been designated by the Minnesota <br />Department of Transportation as eligible for certain construction <br />costs reimbursement from the Municipal State Aid Highway funds and <br />identified as S.A.P. 146-020-04; and <br />WHEREAS, plans for this project S.A.P. 62-601-04, S.A.P. <br />146-020-04 showing proposed alignment, profiles, grades and cross <br />sections for the improvement of County State Aid Highway 1 with the <br />limits of the City as a County State Aid Highway have been presented <br />to the City; and <br />WHEREAS, the project includes, in addition to other things, <br />grading, concrete curb and gutters, storm sewer, and City utility <br />adjustments, and/or improvements; and <br />WHEREAS, the grading provisions require acquisition of certain <br />right of way and temporary construction and slope easements prior to <br />construction; and <br />WHEREAS, the Minnesota Department of Transportation has <br />determined allowable credit for storm sewer outfall lines previously <br />constructed prior to the project, and that 78.99% of this storm sewer <br />system is eligible for a combination of State Aid Highway funds as <br />present in D.V. Halvorson, Mn/DOT Hydraulics Engineer, office <br />memorandum dated February 16, 1990; and <br />WHEREAS, said hydraulics memorandum identifies 7.86% as the City <br />share of the storm sewer cost; and <br />WHEREAS, the design and plan preparation by the consulting firm <br />BRw, Inc. was performed under a separate agreement with the County; <br />and <br />WHEREAS, the City and County will participate in the cost, <br />maintenance and operation of this segment of County Road J as <br />hereinafter set forth. <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br />1. The County shall prepare, or cause to be prepared, the <br />necessary plans, specifications and proposals, take bids, and with <br />concurrence of the City, award a contract for the construction of <br />this project, S.A.P. 62-601-04, the County shall perform the <br />construction inspection. The County shall maintain adequate records <br />and assist the City in obtaining cost reimbursement of its cost items <br />identified under project S.A.P. 146-020-04. <br />2. The City shall acquire and pay for all rights of way and <br />easements required for the construction of the project in the County <br />within the City. <br />90022-2 <br />
