MEMO TO: MAYOR AND CITY CUUNCI�u` v <br />FROM: CLERK-ADMINISTRATU <br />DATE: FEBRUARY 23, 1987 <br />SUBJECT: JLN DEVELOPMENT <br />At your March 2nd Agenda Session representatives of JLN <br />Development will be present to discuss with you the matter of <br />where the T.H. 10 median cut and access road will be located for <br />their development. <br />The reason this matter is brought before you is that it appears <br />the developers are unable to reach an agreement with Bob Waste <br />for the purchase of his property and, therefore, they wish to <br />relocate the road accessing their site off of. Highway 10 from a <br />center line located on the property line between the Pinecrest <br />Property and Mr. Waste's property to a location to the immediate <br />east which would place the road directly on the western border of <br />their site. Issues arise regarding this which require Council <br />direction, namely, <br />1) Should the Council agree with the relocation of the <br />access road and median cut, extension of the road onto <br />the Herbst property would result in the need for <br />acquisition of the property including a single <br />family residence and garage directly to the west of <br />the Perkins Restaurant and provision for future access <br />to the road on the JLN site by the developer of the <br />Waste property. In the case of the single family <br />residence, the need for the acquisition of this pro- <br />perty in order to extend a road into the Herbst site <br />could present the City with the need to pursue <br />condemnation action. <br />2) Should the City refuse to allow the relocation of the <br />access road from that which was contained in the ori- <br />ginal proposals by JLN, acquisition of a small portion <br />of the Waste property would be necessary for <br />construction of this road. Should friendly acquisition <br />prove to be impossible, the City may again need to step <br />in and acquire the property through condemnation action. <br />Representatives of JLN will be present to discuss with the <br />Council their desires and the present status of their own <br />negotiations with Mr. Waste. <br />Another issue has come to the forefront which Staff feels needs <br />to be addressed at this time in order to receive clear direction <br />regarding the City Council's desires for development of this <br />area. At the present time, representatives of JLN Development <br />and the owner of the single family residence directly to the west <br />L- of McDonalds have been unable to reach agreement regarding the <br />
