If it is the City Council's desire to <br />include this property in the JLN Development in order to prevent <br />this parcel from becoming landlocked and essentially <br />undevelopable, it would seem appropriate for the City to step <br />into the acquisition process at this time. Staff would suggest <br />that the first action on the part of the City, should it be your <br />desire to include this parcel in the development, would be to <br />attempt to mediate a purchase agreement between the property <br />owner and JLN. Should that not be possible, condemnation of the <br />property would be the only alternative available besides not <br />including it in the development. If condemnation becomes the <br />only available alternative and the Council determines that such <br />action is appropriate, the City would be able to show that <br />through their actions they have attempted to mediate a friendly <br />acquisition of the property and that a public purpose is clearly <br />involved in the acquisition. Also, acquisition through condemna- <br />tion at that time would not appear to set a precedent of <br />unacceptable proportions as the City has clearly shown that we <br />will not pursue condemnation proceedings unless it is the only <br />viable alternative after all other possibilities have been <br />exhausted. <br />Staff will look forward to discussing this matter with you at the <br />March 2nd Agenda Session and receiving direction at that time. <br />DFP/mjs <br />C, <br />
