't'hts documenL rhal.l be rererred to as the "Development <br />contract", and said document cannot he transferred or assigned by <br />Elie Developer except and with the wri.tten permission of the City, <br />granted pursuant to a resolution or the City Council.. <br />3. All improvements required herein to be performed by the <br />Developer shall be constructed and paid for by said Developer <br />pursunnt to appropriate permits and approval from any governmental <br />agency, such approval and any environmental assessments or environ- <br />mental impact statements required to be obtained by and prepared at <br />the expense of said Developer. <br />4. All public improvements, Jr any, required to be conslruLc <br />ted by the Developer pursuant to this Agreement shall be performed <br />by the Developer with such materials and equipment as required by <br />the City under the direct supervision of the city and shall be in <br />conformance with any and all regulations in force at the time of <br />constt:uction, and the City is hereby granted the right of access to <br />Elie development site to inspect said ¢nnstruction at such times as <br />the City may direct. <br />5.
